in july 2012 osaka-based general union founded branch @ peppy kids club. branch formally declared company, , demands submitted. demands working rules made available staff, explanation of how company ensures staff enrolled in unemployment insurance, , when teachers sent on business trips, company should directly pay hotel rather requiring teacher , reimbursing them.


the company involved lawyer, responded union, , negotiations held on august 6, 2012, company respond union s demands in writing august 17, 2012 company claimed official policy nationwide , did not happen, result of communication errors between head office , branch office. union subsequently announced company had agreed prepay hotels when necessary teachers stay in them 1 or 2 nights. union announced company reimburse teachers receipts when there small errors company name written on receipt.


the union highlighted fact japanese teachers, majority of peppy s teaching staff, not enrolled in unemployment insurance, , work longer hours foreign staff. new confidentiality agreement proposed union saw attempt intimidate jts [japanese teachers] , put them in place .


the general union part of national union of general workers (nugw), affiliated national trade union council (zenrokyo).


dismissal of branch chair

subsequently, company non-renewed chair of gu union branch, after 8 years of employment. company claimed fired poor performance , failed improve teacher , according union teachers evaluations had been in 96-97% range reason pretext , real reason dismissal union busting. union demanded firing revoked, deadline of november 8, 2012, company declined so.


this led other teachers join union, , gu filed unfair labor practice osaka labor relations commission on company s breaches of trade union act of 1949. union advised company planned push ahead strike action, , company counteracted removing branch chair teaching schedule, , began calling other teachers wanting know details of strikes, intimidated teachers , breach of trade union law.


subsequently strikes started @ company. settlement brokered , branch chair returned work. company subsequently attempted non-renew him again, , strikes started once again.


resolution of dispute

union action continued, , grievance procedure established. dispute on dismissal of branch chair later resolved mediation @ osaka labor relations commission in 2016.
